Village of New Baden Village Board met June 3.

The Regular Meeting of the New Baden Village Board met Monday, June 3, 2019, at New Baden Village Hall, 1 East Hanover Street. Mayor Picard called the meeting to order at 7:00 pm.

Present and answering to roll call: Mayor Christy Picard; Trustees Bob Oster, Jordan Pettibone, Taylor Zurliene, Randy Joe Linthicum, and Nicole Pederson. Absent: and Trustee Tom Kuhn. Staff Members Present: Village Clerk Teri Crane; Village Administrator Mike Bolt; Chief of Police Chuck Mackin; Attorney Doug Gruenke of Bruckert, Gruenke & Long, P.C.; and EMS Director Allen Gilbert; Treasurer Casey Pierce; and Chief Building & Zoning Official Jerry Green. Staff Members Absent: Commissioner of Public Works Ronald V. Renth.

Treasurer’s Report

Treasurer Casey Pierce provided the May Treasurer’s Report for Board review.

Consent Agenda

A motion was made by Trustee Oster and seconded by Trustee Linthicum to approve the Consent Agenda, which includes the of payment of current invoices and the Minutes from the June 3, 2019, regular meeting.

Ayes: Oster, Pettibone, Zurliene, Linthicum, Pederson.

Nays: None.

Absent: Kuhn.

A majority of the Board voting aye, the motion carried.

Resolution 2019-06- 17-A: Approving the John Hancock Employer-Funded Money Purchase 457 Retirement Plan for the Chief of Police and Authorizing Participation Therein

A motion was made by Trustee Pettibone and seconded by Trustee Zurliene to approve Resolution 2019-06-17-A: Approving the John Hancock Employer- Funded Money Purchase 457 Retirement Plan for the Chief of Police

and Authorizing Participation Therein. Pursuant to the Employment Agreement between the Village of New Baden and Chief of Police Mackin, the Village will develop a retirement alternative vehicle. Mr. Mackin, at his previous place of employment, was enrolled in the Illinois Downstate Police Pension Fund rather than the Illinois Municipal Retirement Fund (IMRF). The Village of New Baden participates in the IMRF. Pursuant to 40 ILCS 5/3-109.1, after January 1, 2019, a person may not elect to participate in the IMRF as the Chief of Police, unless that person was a participating employee before January 1, 2019. This 457 Plan is only for Mr. Mackin. The Village has previously created a 457 Plan that other employees can voluntarily contribute; Administrator Bolt is working on re- establishing enrollment.

Absent: Kuhn.

A majority of the Board voting aye, the motion carried.

Memorandum of Understanding to the Collective Bargaining Agreement with the New Baden Police Department

A motion was made by Trustee Zurliene and seconded by Trustee Pettibone to approve a Memorandum of Understanding (MOU) to the Collective Bargaining Agreement (CBA) for the New Baden Police Department. The CBA provides that Police Officers with the New Baden Police Department receive one hundred twenty (120) paid sick hours per year, effective on the first day of January each year. The CBA also provides that an employee may request an advance of the anticipated sick leave in the event that an employee, or his/her immediate family, require hospitalization or surgery. The granting of advanced sick leave is at the discretion of the Village Board and shall not exceed two hundred forty (240) hours. The CBA does not provide reimbursement from the employee if the employee leaves the employment of the Village prior to the repayment of advanced sick leave. The MOU spells out the terms for which the sick leave is paid back by the employee.

Ayes: Oster, Pettibone, Zurliene, Linthicum, Pederson. 

Nays: None.

Absent: Kuhn.

A majority of the Board voting aye, the motion carried.

Advanced Sick Leave: Police Officer Nate Hagemann

A motion was made by Trustee Zurliene and seconded by Trustee Pederson to authorize the advancement of up to sick leave to Police Officer Nate Hageman, not to exceed 240 hours. Officer Hagemann had knee surgery at the end of May 2019; he is expected to return to work in the next week.

Ayes: Oster, Pettibone, Zurliene, Linthicum, Pederson.

Nays: None.

Absent: Kuhn.

A majority of the Board voting aye, the motion carried.

Foreclosure of Lien: 304 S 9th St

Attorney Gruenke addresses this topic. He did clarify that it was a “Foreclosure of Lien” not a “Condemnation” as the agenda stated. The Village of New Baden cleaned up the property in November and December 2017 by hiring an outside company. A lien was placed on the property in the amount of $3,682.26. The property now appears to be abandoned; trailer in disrepair, some grass maintained by neighbor, and all mail being returned to Village Hall. Mr. Gruenke will start the process of Foreclosure by ordering a title report; he then explained the procedure. This is a several month process. He will keep the Board apprised of the situation.

New Ambulance

Discussion on new Ambulance purchase. EMS Director Allen Gilbert is working on obtaining updated quotes for the new ambulance, he will provide as soon as available. Trustee Linthicum would also like to see quotes on remodeling the current box and remounting on a new chassis, comparing prices on both the 2000 and 2009 ambulances. Mr. Gilbert stated there is no new update on the grant, that FEMA has been occupied with all of the flooding, but if needed, a waiver could be issued to purchase a new vehicle in the interim, while waiting on official word of the grant award.

There being no further business to be brought before the Village Board, a motion was made by Trustee Zurliene and seconded by Trustee Oster to adjourn the meeting.

Ayes: Oster, Pettibone, Zurliene, Linthicum, Pederson.

Nays: None.

Absent: Kuhn.

A majority of the Board voting aye, the motion carried, and the meeting adjourned at 7:42 pm.
