City of Litchfield City Council met July 2.

City of Litchfield Regular Council Meeting Minutes July 2, 2019

Mayor Steven Dougherty called the Regular Meeting to order on July 2, 2019 at 6: 30 p.m. The Pledge ofAllegiance was recited. Present on roll call were Alderpersons Dwayne Gerl, Marilyn Sisson, Dave Hollo, Mark Brown, Kassidy Paine, Tim Wright, Woody Street, and Ray Kellenberger. The Mayor declared that a quorum was present.

Appointment: Alderman Brown made a motion, seconded by Alderwoman Sisson to appoint Cass Cooper to the Tourism Advisory Committee with a term to expire May 2022.

Other Business:

Alderwoman Sisson made a motion, seconded by Alderman Gerl to accept the minutes of the June 20, 2019 meeting. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Alderman Street made a motion, seconded by Alderman Gerl to direct the City Clerk to transfer funds from the city sales tax to the City' s general fund to issue checks and authorize to pay the bills. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

New Business:

Economic Development: Alderman Kellenberger made a motion, seconded by Alderman Street to approve a partial release of the security for Philsam Properties LLC associated with the sale of lots to Litchfield Unlimited for the development of the recreational center. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Alderman Kellenberger made a motion, seconded by Alderman Brown to approve a proposal with Gewalt Hamilton Associates, Inc for the grant preparation services for an IDNR OSLAD grant to develop a recreation sport complex contingent upon agreement of the property owner. 

The Mayor directed a roll call vote:

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Building/Zoning: Alderman Kellenberger made a motion, seconded by Alderman Street to approve an Ordinance Amending the Use of Signs in the City of Litchfield, Montgomery County, Illinois. Zoning Office Bob Sneed commented that the changes in the Ordinance were to provide clarification as well as to give some new guidelines. He specifically mentioned providing a definition and regulations for A- frame signs ( sandwich boards). Alderman Street asked about the definition of a temporary sign. Sneed responded that a temporary sign is any sign that is displayed for less than 365 days. A permanent sign is displayed 365 days or more as opposed to the earlier time limit of 60 days thereby giving businesses more flexibility.

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None.

Fire: Alderman Street made a motion, seconded by Alderman Kellenberger to approve the purchase and installation of seven( 7) overhead garage doors at Fire Station# 1 to include new door openers from Midwest Door in Pawnee, IL at a cost not to exceed$ 23, 650 and to authorize the Mayor to sign documents and the City Clerk to issue a check upon satisfactory completion. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Alderman Street made a motion, seconded by Alderman Hollo to approve the purchase of an annual subscription for Target Solutions Training System for the amount of$1, 641 and authorize the Mayor to sign the agreement and authorize the City Clerk to issue a check for the first-year subscription and subsequent annual renewals. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Administration: Alderman Street made a motion, seconded by Alderman Brown to approve an Ordinance annexing 207 Arrowhead Trail, PIN# 10- 34- 481- 001. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Tourism: Alderwoman Sisson made a motion, seconded by Alderman Gerl to approve the award of grant monies to the Litchfield Airport Authority in an amount not to exceed$ 300 for the Route 66 Jet Rally to be held September 6- 8, 2019.

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Alderwoman Sisson made a motion, seconded by Alderwoman Paine to adopt an Ordinance prohibiting animals at Litchfield Pickers Market. Tourism Coordinator Sarah Waggoner explained that the presence of animals at the Pickers Market has become more and more of a problem. She said that two weeks after the last market she was continuing to get reports and comments about dog fights and sanitation issues. 

The Mayor directed a roll call vote:

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Streets: Alderwoman Paine made a motion, seconded by Alderwoman Sisson to approve a Resolution for Maintenance for the use of additional $24,495 of MFT funds for the fiscal year ending 2020 and authorize the City Clerk to sign the agreement. 

The Mayor directed a roll call vote:

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Finance: Alderman Gerl made a motion, seconded by Alderwoman Sisson to authorize the City Clerk to release all or portions ofthe Executive Session minutes from the following Executive Sessions: January 4, 2018; March 15, 2018; April 5, 2018; May 3, 2018; May 17, 2018; June 7, 2018; June 21, 2018; July 19, 2018; August 2, 2018; September 6, 2018; October 4, 2018; October 18, 2018; November 1, 2018; November 15, 2018; December 6, 2018; December 20, 2018; January 3, 2019; January 17, 2019; February 7, 2019; February 21, 2019; March 7, 2019 and March 21, 2019.

 The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Police: Alderman Wright made a motion, seconded by Alderman Street to approve the purchase of four( 4) Panasonic Toughbook Mobile Data Computers for$ 14,000 from CDS Office Technologies and to authorize the City Clerk to issue payment of$ 14,000 to CDS Office Technologies. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Alderman Wright made a motion, seconded by Alderwoman Sisson to approve a reimbursement agreement with Colton Faure. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger.

Nay: None. 

Motion carried.

Police Officer Colton Faure was sworn in by City Clerk Carol Burke.

Executive Session: Alderwoman Sisson made a motion, seconded by Alderman Kellenberger to Enter into Executive Session, as allowed under the Illinois Open Meetings Act, as found in Chapter 5 of the Illinois Compiled Statutes, Section 120, to address these certain and restricted items:

Litigation, when an action against, affecting or on behalf of the particular public body has been filed and is pending before a court or administrative tribunal, or when the public body finds that an action is probable or imminent, in which case the basis for the finding shall be recorded and entered into the minutes of the closed meeting." ( 5ILCS 120/2(2)( C)( 11)

The purchase or lease of real property for the use of the public body, including meetings held for the purpose of discussing whether a particular parcel should be acquired." ( 51LCS 120/ 2( C)( 5))

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Executive Session was entered at 6:51 p.m.

Alderman Brown made a motion, seconded by Alderman Kellenberger to return to open session at 7: 04 p.m. 

The Mayor directed a roll call vote: 

Aye: Gerl, Sisson, Hollo, Brown, Paine, Wright, Street, Kellenberger. 

Nay: None. 

Motion carried.

Having no further business, Alderman Street made a motion, seconded by Alderman Kellenberger to adjourn the regular meeting of the Litchfield City Council.

The Mayor called for a voice vote, motion carried, and the regular meeting adjourned at 7:05 p.m.
