City of Taylorville City Council met Dec. 2.

Here is the minutes provided by the council:

The Mayor called the meeting to order at 7:10 P.M.

The Invocation was given by Pastor Jerry Thorpe of Faith Community Church. Mayor Barry led the Council and the assembled group in the Pledge of Allegiance.

Roll Call - Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety reported present.

YOUTH OF THE MONTH

Mayor Barry recognized the Taylorville Junior High 7th Grade Girls Basketball Team for an outstanding record of 23-1 and a Regional Championship! The girls are on a 21 game winning streak and will play for the Sectional Championship on Wednesday, December 4, 2019.

APPROVAL OF MINUTES

Motion by Alderman Dorchinecz and seconded by Alderman Olive to utilize the Omnibus Vote Designation for various meetings. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

Motion by Alderman Bryant and seconded by Alderman Skultety to approve the minutes of the Public Hearing held November 18, 2019; the Regular City Council Meeting held November 18, 2019; the Finance Committee Meeting held November 25, 2019; The Ordinance Committee Meeting held November 25, 2019; and the Public Facilities Committee Meeting held November 26, 2019. 

OMNIBUS VOTE

HATHAWAY HOMES OF TAYLORVILLE PHASE 2 CONSTRUCTION PLANS

Motion by Alderman Budd and seconded by Alderman Olive to approve the Constructions Plans for Hathaway Homes of Taylorville Phase 2, based upon the letter from City Engineer Greene. Roll Call – Aldermen Bryant, Budd, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. Alderman Burtle voted NAY. The Mayor announced the motion carried.

PLAN COMMISSION RECOMMENDATIONS

Chairman Joe Hauser provided a recap of the Plan Commission meeting regarding the Hathaway Homes of Taylorville Phase 2 Final Plat as well as the Addition of Paragraph E to Section 10- 5-6 of the Taylorville City Code. Both were approved by a unanimous vote of (4-0) to recommend to the City Council to approve.

Motion by Alderman Budd and seconded by Alderman Olive to approve the Plan Commission Recommendations and approve the Final Plat for Hathaway Homes of Taylorville Phase 2.

Roll Call – Aldermen Bryant, Budd, Dorchinecz, Driskell, Lanzotti, Olive, and

Skultety voted YEA. Alderman Burtle voted NAY. The Mayor announced the motion carried.

ORDINANCE NO. 3929 – AN ORDINANCE ADDING PARAGRAPH E TO SECTION 10-5-6 OF THE TAYLORVILLE CITY CODE (RE: ADDING SUBDIVISION OF ADJOINING BUILDINGS ON COMMERCIAL PROPERTY AS A SPECIAL USE IN C-1 AND C-2 ZONING DISTRICTS)

Motion by Alderman Burtle and seconded by Alderman Budd to approve the Plan Commission recommendations and approve Ordinance No. 3929 – An Ordinance Adding Paragraph E to Section 10-5-6 of the Taylorville City Code (re: adding subdivision of adjoining buildings on commercial property as a Special Use in C-1 and C-2 Zoning Districts. Mr. Randy Mitchelson will now begin the process to request a Special Use for his building. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety, and Mayor Barry voted YEA. The Mayor announced the motion carried.

ORDINANCE NO. 3930 – ANNUAL ABATEMENT ORDINANCE

Motion by Alderman Budd and seconded by Alderman Driskell to approve Ordinance No. 3930 – Annual Abatement Ordinance. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety, and Mayor Barry voted YEA. The Mayor announced the motion carried.

ORDINANCE NO. 3931 – AN ORDINANCE AUTHORIZING THE CITY OF TAYLORVILLE TO ENTER INTO CERTAIN ANNEXATION AGREEMENTS PURSUANT TO 65 ILCS 5/11-15.1-1 ET.SEQ (STATE BAR ASSOCIATION)

Motion by Alderman Burtle and seconded by Alderman Budd to approve Ordinance No. 3931 – An Ordinance Authorizing the City or Taylorville to Enter into Certain Annexation Agreements Pursuant to 65 ILCS 5/11-15.1-1 Et. Seq.(State Bar Addition). Property owners who’s properties are not contiguous must complete this process to obtain City water. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety, and Mayor Barry voted YEA. The Mayor announced the motion carried.

ORDINANCE NO.3932 – AN ORDINANCE AMENDING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY (RE: SUSAN JOHNSON – 1700 E. MAIN CROSS PROPERTY)

Motion by Alderman Budd and seconded by Alderman Burtle to approve Ordinance No. 3932 – An Ordinance Amending the Zoning Classification of Certain Property (re: Susan K. Johnson – 1700 East Main Cross Property). Roll Call – Aldermen Budd, Burtle, Dorchinecz, Olive, and Mayor Barry voted YEA. Aldermen Bryant, Driskell, Lanzotti, and Skultety voted NAY. The Mayor noted that his vote to break the tie was based upon the surrounding properties currently zoned C-2, C-1 and R-1. The Mayor announced the motion carried.

ORDINANCE NO. 3933 – AN ORDINANCE AMENDING SECTION 3-3-5 OF THE TAYLORVILLE CITY CODE(RE: INCREASING LIQUOR/GAMING ANNUAL LICENSE FEE)

Motion by Alderman Bryant and seconded by Alderman Dorchinecz to approve Ordinance No. 3933 – An Ordinance Amending Section 3-3-5 of the Taylorville City Code (re: increasing liquor/gaming annual license fee). All establishments with gaming will now pay $3,000.00 annually for their license fee, with the exception of Clubs. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety and Mayor Barry voted YEA. The Mayor announced the motion carried.

ORDINANCE NO. 3934 – AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT TO THE BUSINESS DEVELOPMENT DISTRICT NO. 1 REDEVELOPMENT AGREEMENT BY AND BETWEEN CITY OF TAYLORVILLE, ILLINOIS AND TINA COASH AND TALIA’S COOKIES, LLC AND BERNARD CURVEY

Motion by Alderman Skultety and seconded by Alderman Bryant to approve Ordinance No. 3934 – An Ordinance Approving and Authorizing the Execution of a First Amendment to the Business Development District No. 1 Redevelopment Agreement by and between City of Taylorville, Illinois and Tina Coash and Talia’s Cookies, LLC and Bernard Curvey. The initial Ordinance and Agreement did not include the landlord and owner of the property, Bernard Curvey. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinez, Driskell, Lanzotti, Olive, Skultety, and Mayor Barry voted YEA. The Mayor announced the motion carried.

COMMITTEE REPORTS

FINANCE

2020 WORKER’S COMPENSATION POLICY RENEWAL

Motion by Alderman Budd and seconded by Alderman Driskell to approve the January 1, 2020 to December 31, 2020 Workers Compensation Policy Renewal Premium of $269,573.00 from Illinois Public Risk Fund. Alderman Budd stated that this premium cost is $2,400.00 per month less than the current rate. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety voted YEA. The Mayor announced the motion carried.

TRUTH-IN-TAXATION ACT ORDINANCE

Motion by Alderman Budd and seconded by Alderman Bryant to direct the City Clerk’s Office to prepare an Ordinance that, pursuant to the Truth-in-Taxation Act, the sum of $3,028,858.35 for the City’s current Fiscal Year 5/1/19 to 4/30/20 upon the taxable property in the City, which amount is less than 105% of the amount extended, or estimated to be extended upon the final aggregate levy of the preceding fiscal year; and a Truth-in-Taxation Public Hearing is not required; this includes a total maximum levy of $282,310.35 for the Taylorville Public Library. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety, and Mayor Barry voted YEA. The Mayor announced the motion carried.

BDD APPLICATION - ROBERT AND REBECCA STEINER – 100 WEST MARKET STREET

Motion by Alderman Budd and seconded by Alderman Olive to forward the application for BDD Benefits from Robert and Rebecca Steiner to Jacob & Kline for further review and preparation of an Ordinance and Agreement, pending completion of the project, submission of receipts and cancelled checks. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, and Olive voted YEA. Alderman Skultety voted NAY. The Mayor announced the motion carried.

SEWER FEE INCREASE

Motion by Alderman Budd and seconded by Alderman Dorchinecz to approve the following per gallon per customer sewer rate, currently set at.00147 per gallon, to the increased five step sewer rate beginning January 1, 2020 as follows: $0.002 per gallon on 1/1/20; $0.00225 per gallon on 1/1/21; $0.0025 per gallon on 1/1/22; $0.00275 on 1/1/23; and $0.003 on 1/1/24. Alderman Burtle felt this was not the appropriate time for an increase; although it is a sewer fee, it will be reflected on the water bills. Alderman Budd noted that the City has had a deficit in the Sewer Fund for years and it cannot continue to operate in the red. Roll Call – Aldermen Bryant, Budd, Dorchinecz, Driskell, Lanzotti, and Olive voted YEA. Aldermen Burtle and Skultety voted NAY. The Mayor announced the motion carried.

TREASURER’S REPORT

Motion by Alderman Budd and seconded by Alderman Skultety to accept the Treasurer’s Report as presented. The motion carried (8-0).

ORDINANCE

ORDINANCE NO. 3935 – AN ORDINANCE AMENDING CHAPTER 12 OF TITLE 2 OF THE TAYLORVILLE CITY CODE (RE: REGULATING AND LICENSING OF TAXICAB DRIVERS

Motion by Alderman Bryant and seconded by Alderman Driskell to approve Ordinance No. 3935 – An Ordinance Amending Chapter 12 of Title 2 of the Taylorville City Code (re: Regulating and Licensing of Taxicab Drivers). Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

PUBLIC FACILITIES

JOHNSON ENGINEERING CONTRACT - PHASE 3

Motion by Alderman Skultety and seconded by Alderman Olive to proceed with Phase 3 of the existing contract with Johnson Engineering, PC, regarding the generator and building upgrades, at a cost not to exceed $1,800.00 for the bidding process. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

TELEVISION AND VIDEO EQUIPMENT IN COUNCIL CHAMBERS

Motion by Alderman Skultety and seconded by Alderman Bryant to approve Electrical Services Company, a Division of Rathje Enterprises(Bodine Electric), upon execution of the City’s form contract and proof of insurance, to complete the electrical work needed to install a new television and all other video equipment in the Council Chambers at a cost not to exceed $1,500.00; cost of television and equipment not to exceed $500.00. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

PAYMENT OF BILLS

Motion by Alderman Budd and seconded by Alderman Burtle to authorize payment of bills. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

BUSINESS FROM THE PUBLIC

Mayor Barry asked if any member of the public desired to speak to the Council. Alderman Bryant commended the Mayor on the event held on December 1, 2019 to commemorate the 2018 tornado and celebrate all who assisted in our community.

Motion by Alderman Burtle and seconded by Alderman Olive to adjourn. Motion carried (8-0). The meeting adjourned at 7:46 P.M.
