At the regular meeting held in the Council Chambers by the City Council, April 6, 2020, the following proceedings were held and entered in this record in the following words and figures to wit:

The Mayor called the meeting to order at 7:00 P.M.

The Invocation was written by Pastor Zach Crowley of Taylorville Christian Church and read by Mayor Barry. Mayor Barry led the Council and the assembled group in the Pledge of Allegiance.

Roll Call - Aldermen Budd and Driskell were present in the Council Chambers. Aldermen Bryant, Burtle, Dorchinecz, Lanzotti, Olive, and Skultety reported present through FaceTime due to COVID-19 precautions.

APPROVAL OF MINUTES

Motion by Alderman Dorchinecz and seconded by Alderman Bryant to utilize the Omnibus Vote Designation for various meetings. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

Motion by Alderman Driskell and seconded by Alderman Skultety to approve the minutes of the Public Hearing held March 16, 2020; and the Regular City Council Meeting held March 16, 2020. OMNIBUS VOTE

ORDINANCE NO. 3951 – AN ORDINANCE PERTAINING TO LOCAL STATE OF EMERGENCY

Motion by Alderman Burtle and seconded by Alderman Budd to approve Ordinance No. 3951 - An Ordinance Pertaining to Local State of Emergency with changes to Article 2 (d) to include removing items 4-7. This is recommended by the Illinois Municipal League to grant the Mayor certain powers necessary to keep the citizens safe during the pandemic. Roll Call – Aldermen Bryant, Budd, Burtle, Olive, and Skultety voted YEA. Aldermen Dorchinecz, Driskell, and Lanzotti voted NAY. The Mayor announced the motion carried.

ORDINANCE NO. 3952 – AN ORDINANCE AMENDING SUBPARAGRAPH C.1 OF SECTION 7-4-6 OF THE TAYLORVILLE CITY CODE (RE: BOAT DOCKS)

Motion by Alderman Olive and seconded by Alderman Skultety to approve Ordinance No. 3952 – An Ordinance Amending Subparagraph C.1 of Section 7-4-6 of the Taylorville City Code (re: Boat Docks). Per City Attorney Romano, the Ordinance will state that any request for a boat dock over 25’ will be handled on a case by case basis and will have a maximum length of 40’. The entire structure must have white solar lighting on the perimeter and must be visible for 500’. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety, and Mayor Barry voted YEA. The Mayor announced the motion carried.

ORDINANCE NO. 3953 – AN ORDINANCE ADDING SUBPARAGRAPH 4. TO PARAGRAPH 1. OF SECTION 7-1-4 OF THE TAYLORVILLE CITY CODE (RE: ALLOWS DUAL TENANTS OF SAME LAKE LOT LEASE)

Motion by Alderman Dorchinecz and seconded b Alderman Skultety to approve Ordinance No. 3953 – An Ordinance Adding Subparagraph 4. to Paragraph 1. Of Section 7-1-4 of the Taylorville City Code (re: allows dual tenants of same lake lot lease). This applies if and only if ALL lake lots are rented and will require double rent and security deposit. It will be handled on a case by case basis and will require City Council approval, as not all lake lots are conducive to more than one tenant on a lot. Roll Call – Aldermen Budd, Burtle, Dorchinecz, Skultety, and Mayor Barry voted YEA. Aldermen Bryant, Driskell, Lanzotti, and Olive voted NAY. The Mayor announced the motion carried.

ORDINANCE NO. 3954 – AN ORDINANCE PROHIBITING BURNING OF LEAVES, VGETATION, WEEDS, GRASS CLIPPINGS & TREE LIMBS DURING COVID-19 PANDEMIC

Motion by Alderman Driskell and seconded by Alderman Dorchinecz to approve Ordinance No. 3954 – An Ordinance Prohibiting Burning of Leaves, Vegetation, Weeds, Grass Clippings & Tree Limbs During Covid-19 Pandemic. As Covid-19 has adverse effects on the lungs, it was felt The ban on burning to be best during this time, as a one-time only prohibition. Roll Call – Aldermen Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Mayor Barry voted YEA. Aldermen Bryant and Skultety voted NAY. The Mayor announced the motion carried.

ORDINANCE NO. 3955 – AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE BUSINESS DISTRICT AGREEMENT BY AND BETWEEN THE CITY OF TAYLORVILLE & ROBERT STEINER AND REBECCA STEINER

Motion by Alderman Budd and seconded by Alderman Dorchinecz to approve Ordinance No. 3955 – An Ordinance Approving and Authorizing the Execution of an Amendment to the Business District Agreement by and between the City of Taylorville & Robert Steiner and Rebecca Steiner. The original agreement is in need of the extension for completion of work due to the contractor’s schedule. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, Skultety, and Mayor Barry voted YEA. The Mayor announced the motion carried.

RESOLUTION NO. 1446 – A RESOLUTION AUTHORIZING EXECUTION OF EASEMENT AGREEMENT AND ACKNOWLEDGEMENT AND CONSENT AGREEMENT (RE: JAYNES PARK STORM SEWER PROJECT)

Motion by Alderman Dorchinecz and seconded by Alderman Driskell to approve Resolution No. 1446 – A Resolution Authorizing Execution of Easement Agreement and Acknowledgement and Consent Agreement (re: Jaynes Park Storm Sewer Project). This easement extends 100 feet onto the Christian County Fairgrounds property. The Taylorville Park District should address at a future meeting. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, and Skultety voted YEA. Alderman Olive Abstained. The Mayor announced the motion carried.

RESOLUTION NO. 1447 – A RESOLUTION TO APPROVE “CATCH-BASIN” EASEMENT AGREEMENT (RE: MARSHA BLACKMAN PROPERTY)

Motion by Alderman Burtle and seconded by Alderman Skultety to approve Resolution No. 1447 – A Resolution to Approve “Catch-Basin” Easement Agreement (re: Marsha Blackman Property). This is for the catch basin only and easement for the pipe. The property owner will provide the pipe. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

SPECIAL PAYMENT PROVISIONS FOR LIQUOR LICENSE HOLDERS

Motion by Alderman Driskell and seconded by Alderman Budd to approve the special payment provisions for liquor license holders based on the following recommendations by the Mayor: one third payment due on June 1, 2020 and remaining two thirds payment due on July 1, 2020. This would apply to all liquor license holders due to the six-week mandatory shutdown and resulting loss in revenue. City Attorney Romano noted that this will require an Ordinance. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

PURCHASE OF CEMETERY TRACTOR

Motion by Alderman Burtle and seconded by Alderman Bryant to approve the purchase of a 2020 JD X750 Garden Tractor with high capacity deck at a cost not to exceed $10,500.00 to be paid from the Cemetery Perpetual Care Fund Interest Account. This account is used only for equipment purchases for the Cemetery. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

ADVERTISEMENT FOR BIDS – CONCRETE, CURB AND GUTTER, SIDEWALKS, FUEL, AND MOWING

Motion by Alderman Skultety and seconded by Alderman Burtle to ratify the advertisement for bids for Concrete, Curb and Gutter, Sidewalks, Fuel, and Mowing for the period of May 1, 2020 – April 30, 2020. It was noted that this is an annual process and was inadvertently omitted from the March 2020 Street and Sewer Committee Meeting for approval. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

COMMITTEE REPORTS

No Committee Meetings were held due to the COVID-19 Protocols

PAYMENT OF BILLS

Motion by Alderman Budd and seconded by Alderman Burtle to authorize payment of bills. Alderman Budd noted that here was a bill for sewer work on the Norris property that was to be pulled due to the incorrect amount charged to the City. The reimbursable amount should be $500.00, not the $1000.00 that was requested. The new total should be $354,755.37. Roll Call – Aldermen Bryant, Budd, Burtle, Dorchinecz, Driskell, Lanzotti, Olive, and Skultety voted YEA. The Mayor announced the motion carried.

BUSINESS FROM THE PUBLIC

Per the Social Distancing Guidelines, constituents were instructed to email any comments to the Mayor. None were received. Treasurer Nation had received a text from Ann Coady with her concerns regarding curfew and religious restrictions pertaining to the COVID-19 pandemic. In response, the Mayor noted that he and Chief Wheeler have discussed and do not feel a curfew is necessary at this time. City Attorney Romano stated that the Mayor will now have the authority to address per the Emergency Declaration. A brief discussion was held regarding regulating the number of shoppers in any given time in stores such as Wal Mart. Mayor Barry will discuss options for protocols with the managers of the stores.

Mayor Barry has been approached regarding the number of UTV stickers available for purchase. 24 have been purchased to date; he would like to expand this number. The Aldermen were in agreement that the limit of 25 was set for the trial period to determine if any issues arise with these vehicles. This will be addressed when the trial period is complete.

Motion by Alderman Burtle and seconded by Alderman Dorchinecz to adjourn. Motion carried (8- 0).
