City of Kinmundy City Council met June 12.

Here are the minutes provided by the council:

The regular June 2025 meeting was called to order by Mayor Angie Diss. The Pledge to allegiance was recited.

ROLL CALL

Those present were council member Paul Eatherton, Matt Gura, Cory Thompson, Amy Davis, Curt Jones and Gary Cooper. Mayor Angie Diss, Treasurer Cindy Garrett and Clerk Jane Middleton were also present along with Travis Potter, Luke Smith, Joe Duffy and Teresa Hanks.

Motion was made by Curt Jones to approve the bills and minutes. seconded by Amy Davis. Motion carried,

FINANCIAL REPOIRT

The financial report was submitted by treasurer Cindy Garrett. Motion was made by Matt Gura to approve the financial report and seconded by Curt Jones. Motion carried unanimously.

PUBLIC RECOGNITION

Mayor Diss presented a letter from an anonymous citizen. They were complaining about the old City Lake trails and four wheelers destroying the lake property. They requested it be stopped and more signs put in place advising no four wheelers allowed.

Mayor Diss advised anyone participating in public recognition to have five minutes to state their business.

TONY WIMBERLY

Wimberly was advising the weeds on the fourth street bridge at Donoho's were getting out of hand. He also advised the bridge needed attention with rails needing painted. There are four wheelers around Wimberly's house from 11p.m. on into the early morning hours. He thinks they are coming from the old Pola Robb house just down the street from him. He requested the police officer address the situation.

LIBRARY REPORT

The library report was presented by Council member Gura. See attached.

POLICE REPORT

The police report was presented by Officer Joe Duffy. See attached.

There is a huge problem with children causing damage in Kinmundy. A child threw a brick through the window at the resale store, Back in the Day, destroying a hundred year old window, glass blocks were broken in the Madison Street Preservation building, power was turned off at the Kinmundy General Store twice, causing extensive damage, children are standing on the soda machine owned by Gary Cooper at the corner of 2nd and Madison streets, they have also been pulling and trying to replant the flowers in the downtown gazebo.

The Marion County State's Attorney advised to make the parents supervise the children when they are placed on a station adjustment and required to perform community services. Councilman Thompson wanted to know what happened when the parents don't show. Officer Duffy advised the matter would then be submitted to the State's Attorney's office.

Councilman Cooper advised there were girls at the downtown gazebo screaming and cussing at his son. Mayor Diss said she had to check girls screaming and cussing at the gazebo at 9 p.m. one night.

Mayor Diss suggested putting a 7p.m. curfew on all children under 16 years of age. There will be a 7 p.m. curfew placed on all children under 16 years of age immediately. Mayor Diss will request the city attorney to prepare an ordinance for this effect immediately. Officer Duffy will issue a citation for each violation. The first violation will be four hours of community service with parents supervising. The second violation will be eight hours of community service with parents supervising. If they refuse the citation will be forwarded by Officer Duffy to the State's Attorney's office for prosecution.

Council woman Amy Davis did not want a 7 p.m. curfew. She said it needed to be a later time. She thought a curfew would be burdensome. Mayor Diss advised the time could be changed by the council. Davis said the rules needed to be enforced by the police before making a new curfew. Davis said her daughter and other kids would be negatively affected and she had not done anything wrong. Mayor Diss advised the problem had been going on since December 2024 and enforcement of rules had not helped.

Council man Cooper made a motion to place an 8pm curfew on all children under 16 years of age unless accompanied by parent or responsible person over the age of 18. Council member Gura seconded the motion. Motion carried.

WATER REPORT BY TRAVIS POTTER

The 2024 CCR report was submitted to EPA by Potter.

STREET REPORT BY LUKE SMITH

A list of oiling dates for July 1st, 2025, was submitted. See attached.

Most roads have not been oiled since 2020. Travis and Luke are trying to build up and fill potholes. Council Member Cooper said Washington St. from East 1st to fifth street needs oiled and patched. He said there was mud coming through the street where J. D. Yates lives.

COMMITTEE REPORTS

There are no committee reports.

The council again discussed city fees, and no decision was made by the council to raise them. More research will be obtained by the city, with other towns surveyed on their fees.

PARK DEED

T & K Title, formerly Larimer's Title, found where the northeast lots of the city park had been signed over by previous owners to the city. Mayor Diss suggested that the whole park should be under one parcel number. The Council discussed it could cause the taxes to change on the whole entire park. We already have those deeds, so it is not necessary.

APPROPRIATION ORDINANCE #693

Council member Corey Thompson made a motion to accept appropriations ordinance #693. Council member Paul Eatherton seconded the motion. Motion carried unanimously.

GAMING ORDINANCE #694 was tabled by the council. The council discussed passing this ordinance could make it easier for businesses to obtain their state licenses. The supplier usually pays this fee. One business waited longer than a year to obtain their license.

RETURN TO WORK ORDINANCE #695

Motion was made by Curt Jones and seconded by Amy Davis to approve ordinance #695.

Motion carried unanimously.

Motion was made to enter executive session by Corey Thompson for the purpose of real estate, and seconded by Matt Gura. Motion carried unanimously.

Amy Davis made motion to return to regular session meeting. Seconded Curt Jones. Motion carried unanimously.

Dolores Mobley is not upset about the museum being required to pay rent and utilities. It was Marla Shirley's dream. It was understood by Mobley that they can't continue for free. They are not sure what they will do but will redistribute the contents of the museum to the people who donated it and to the respective towns. They will be open on labor day and until October 1st and are good with the rent and utilities. Mayor Diss asked if we wanted to waive the rent until October 1st. Council member Davis said we had already made the decision and all council members agreed they must start paying July 1st, 2025, $300 a month for rent and utilities.

Council member Amy Davis made the motion to adjourn the meeting. Council member Paul Eatherton seconded the motion. Motion carried Unanimously.
