City of Greenville Council met Dec. 11.

Call to Order: The regular meeting of the Greenville City Council was called to order on Tuesday, December 11, 2018 at 7:00 p.m. by Mayor Pro Tem Mike Heath.
Roll Call: Present: Councilman Bill Carpenter, Councilman John Gillard, Councilman Mike Heath and Councilman Kyle Littlefield.
Mayor Gaffner joined the meeting via teleconference.
Also Present: City Attorney Patrick Schaufelberger, City Manager Dave Willey and City Clerk Sue Ann Nelson.
The pledge of allegiance to the United States flag was recited.
Citizen Input: With no comments, citizen input was closed.
CONSENT AGENDA:
Approval of minutes of the November 13, 2018 Regular Council Meeting;
Financial Statements for November 2018;
Approval of Accounts Payable totaling $818,919.01;
Approval of Committee Meeting Minutes of the December 4, 2018 Board of Adjustment Meeting;
Approval of Administrative Reports of the Police

Ordinance 3187 – Outbuilding Size Variance at 1302 E State Route 140: Request from Kenneth Burge for a variance to exceed the maximum outbuilding size to construct a 26’x42’ detached garage or outbuilding. Board of Adjustment unanimously recommended approval of request for a variance to construct a 26’x42’ outbuilding of material comparable to existing dwelling and to be constructed within all mandated setback requirements of the UDC (see ordinance on file for full text).
Approval of Consent Agenda: Motion by Littlefield seconded by Gillard, to approve the consent agenda as presented.

Remote Attendance: Mayor Gaffner was unable to attend the meeting in person due to being out of town on a work assignment. With a quorum being confirmed, motion made by Carpenter, seconded by Littlefield, to allow remote participation by Mayor Gaffner. Mayor Gaffner joined the meeting at 7:05 p.m.

American Oil Mills Development Agreement: TIF Development Agreement with American Oil Mills to develop and operate a soybean crushing mechanical plant producing soybean oil and by-products. American Oil Mills will acquire a 30,000 square foot building on five acres from FastRite. American Oil Mills intends to acquire 22.7 acres in the Industrial Park, and is seeking TIF Development Agreement for assistance in purchasing this land from the City of Greenville. Purchase price will be $8,000 per acre, based on established Industrial Park pricing, for a total cost of $181,600. Development Agreement would have the City of Greenville providing an incentive of $181,600 to cover the cost of the land. Amount of TIF funds paid upfront, will be deducted from total TIF amount due American Oil Mills until the total $181,600 of tax from increment is met. Motion by Littlefield, seconded by Carpenter, to approve TIF Development Agreement with American Oil Mills.

Utility Deposit Fee for Renters: The council had discussed the topic last month, and indicated that it would be brought back in December for council consideration. Mr. Breehne, with 2Creeks Mobile Home Park, indicated that he was not able to attend and asked if the item could be postponed until the next meeting for council consideration. Councilman Gillard indicated he would like to move forward, and made a motion to leave the utility deposit for rental customers unchanged at $100. Mayor Gaffner indicated that he would like to postpone the issue until the January council meeting. Motion died due to a lack of a second. Item will be included on the January agenda.
Ordinance 3188: Annual Tax Levy: After council determination at the November meeting not to exceed a 5% increase for the 2018 tax levy, City Manager Willey presented two options for the upcoming levy, a 5% increase and a 0% increase. City Manager Willey talked about the funding issues involving capital expenditures that have been deferred because funds have not been available, and encouraged the council to consider the 5% increase. Motion by Gillard, seconded by Gaffner, to approve 2018 tax levy totaling $802,889 representing a $0 increase from prior year.

Motion by Heath, seconded by Littlefield, to approve Ordinance 3188 for 2018 tax levy totaling $842,961 representing a 5% increase from prior year (see ordinance on file for full text).

Motion passed 3-2.
Tax Levy must be filed with the County Clerk’s office before the last Tuesday in December.
Ordinance 3189 - Chapter 114: Peddlers and Solicitors: At last month’s council meeting staff presented several changes for discussion to modify the city code regarding issuing solicitor’s permits. Proposed changes included increasing the fee, requiring credentials be worn, limit hours of solicitation, and establish no soliciting parameters. These changes are now being presented in an ordinance for consideration. Motion by Carpenter, seconded by Heath, to adopt ordinance to modify city code for peddlers and solicitors permits (see ordinance on file for text). Ordinance would be effective January 1, 2019.

Drug Update: City Manager reported that the City of Greenville will be sending an officer to serve as part of the drug enforcement task force in January.
Appointment to Boards and Commissions: None.
Old Business: Councilman Littlefield inquired about the vacant Tourism Director position. City Manager reported that he has interviewed several candidates, but has not hired anyone.
City Manager Willey updated the council on the occupancy permit issue, and that he is working on a voluntary inspection program by landlords and will have more information for the council in early 2019.
New Business: Councilmembers recognized and thanked the efforts of the Public Works department for the assistance that was provided to the City of Taylorville following the tornado. Mayor Gaffner acknowledged the efforts of the Public Works department for their participation and decorated backhoe in the Christmas parade.
Recess to Executive Session and Adjourn: At 8:13 p.m., moved by Gillard, seconded by Carpenter, to recess to executive session for Purchase of Real Estate, Section 2 (c) (5); Sale of Real Estate, Section 2 (c) (6); Pending Litigation, Section 2 (c) (11); Personnel, Section 2 (c) (1-2) of the Open Meetings Act. Meeting was adjourned from executive session at 9:14 p.m.
