City of Carlinville City Council met Feb. 18.

Here is the minutes provided by the council:

PRESENT: Alderman Brockmeier, Alderman Downey, Alderman Koller, Alderman Link, Alderman McClain, Alderman Ober, Alderman Oswald, Mayor Deanna Demuzio, City Attorney Dan O’Brien, City Clerk Carla Brockmeier, Police Chief Haley, Woodard & Curran Representative Dan Held, Zoning Administrator Steve Parr Absent: Alderman Howard, City Treasurer/Budget Officer Jody Reichmann

Approval of Previous Minutes - Motion was made by Alderman Ober to approve minutes, seconded by Koller, motion passed unanimously.

Approval of Budget Officers Report/Treasurer’s Report/Police Report/Bills - Motion made to approve all listed by Alderman Ober, seconded by Oswald, motion passed unanimously.

Correspondence - None

Public Comment

Fran Albert sister of disabled adult Ronnie Albert spoke regarding her brother’s life in a CILA home and the positive impact it has made in his life.

Mary Anne Quill, Attorney for Locust Street Resource Center spoke regarding the Special Use Permit at 18 Greenridge Drive. She spoke regarding the number of people that will be living in the home and how no other CILA homes have had a negative impact on any neighborhoods. She asked the City Council to overturn the decision of the Zoning Commission and allow the home at 18 Greenridge Drive to be rezoned community integrated living arrangement.

Chris Seniker from Century 21 spoke on behalf of the sellers at 18 Greenridge Drive (Scott and Jennifer Rodgers). He asked the City Council to overturn the decision of the Zoning Commission and grant the Special Use Permit for 18 Greenridge Drive. He also made the council aware of what the Fair Housing Act states as well as Illinois Human Rights and American with Disabilities Act.

Old Business

IARWC Update – Alderman Oswald reported that she had been to her first meeting as Carlinville’s representative of the IARWC. She reported the well testing has begun and they have formed a SCADA Committee. She reported they are working on securing easements as well, and that she is excited to be a part of the committee.

Authorization Agreement for Roof Replacement at City Hall – A motion was made by Alderman Downey, seconded by Oswald to allow the mayor to sign the Authorization Agreement from MECO for the engineering and architectural design services for the roof replacements at City Hall in the amount of $6,700.00, motion passed unanimously.

New Business

Olivia Turley - Girl Scout Gold Award – Mayor presented a certificate from the City of Carlinville recognizing her Girl Scout Gold Award.

Zoning Advisory Report – The Zoning Commission voted 3-1 to deny a Special Use Permit request by Locust Street Resource Center to operate a Community Integrated Living Arrangement at 18 Greenridge Drive at a public hearing on February 13, 2020. Atty. Dan O’Brien explained to the council that this is a violation of the Fair Housing Act as well as the Americans with Disabilities Act. Alderman McClain made a motion to overturn the vote of the Zoning Commission, Oswald seconded, motion passed unanimously. A motion was then made by Alderman McClain to approve the Special Use Permit at 18 Greenridge Drive, seconded by Oswald, motion passed unanimously.

Change Ordinance on Drug Paraphernalia to Allow Sales – A motion was made by Alderman Oswald to direct the City Attorney to change the ordinance to allow sales of drug paraphernalia within the city limits, seconded by Koller, motion passed 4-3 with Link, McClain, Ober voting nay. The change is due to the legalization of recreational marijuana.

Residency for Officers – Public Safety Committee recommended lifting the 5-mile restriction for city police officers. They recommended we extend it to 25 miles, given the shortage of officers. Only officers within a 5-mile radius will be able to take their cars home. A motion was made by Alderman Downey to approve the change, seconded by McClain, motion passed unanimously.

Lake Leases – Alderman Downey made a motion to allow the mayor to sign the lake leases that have been renewed for 2020, seconded by Oswald, motion passed unanimously.

IML Springfield Conference – IML is sponsoring a seminar for “Not So Newly Elected Officials” the cost is $50.00 per person, Alderman Downey made a motion to allow elected officials to attend, seconded by Oswald, motion passed unanimously.

Squad Replacement – Chief Haley would like permission to replace a 2008 Charger, with a 2019 4-wheel drive truck, cost not to exceed $25,250.00, with trade in could possibly be under $24,000.00. A motion was made to approve by Alderman Ober, seconded by Koller, motion passed unanimously.

Motion to adjourn was made by Alderman Downey at 7:55 p.m., seconded by Brockmeier motion passed unanimously.
