City of Assumption City Council met Oct. 5.

Here are the minutes provided by the council:

Meeting called to order at 7:00 p.m. at the City Hall by Mayor Derek Page who led the Pledge of Allegiance.

Roll call was answered by Alderpersons Sue Burgess, Gary Nelsen, Selena Reed, Kandy Smith, Travis Sullivan and Donny Walden. Also present were Mayor Derek Page, Attorney Gregory Moredock, Treasurer Angel Palmer and City Clerk Janet Waller.

Present in the audience was Mark Bingham from Chastain and Associates, Felicia King, Earl Simmons, Joe Mink and Bob Bantner.

Council Member Smith, seconded by Council Member Walden, made a motion to approve the minutes of September 7, 2022 Council Meeting. Motion carried with Alderpersons Walden, Sullivan, Smith, Reed, Nelsen and Burgess voting aye and 0 nays.

Approval of Bills:

Council Member Smith, seconded by Council Member Nelsen, made a motion to approve the payment of bills as they appear on the Warrant Sheets. Motion carried with Alderpersons Burgess, Nelsen, Reed, Smith, Sullivan and Walden voting aye and 0 nays.

Public Comments on Agenda Items:

No comments.

Communications from the Mayor:

Clean up day is scheduled for October 9 with ACPA.

Congressman Rodney Davis will be at the Water Plant on October 19th at 10:00 am for a district wide tour of the projects that are being funded.

People are encouraged to clean up after their animals at the Railroad Park. There are garbage cans available for the waste.

Assumption has a couple businesses expanding. Sloan’s Implement and Koehl Bros are both building new buildings.

Communications from the City Attorney:

The City is now the title owner for the 2 properties we were working on at 712 E Illinois and 315 N St John. The attorney is working on filing PTAX forms. We have received an appraisal for the 315 N St John property.

Attorney Moredock is leaving private practice on November 21 and has accepted a general council position. An attorney from his law firm will be taking over.

Communications from the Treasurer:

Treasurer Palmer reported the Wasterwater Revolving Loan Payment will be made online by November 6th for $66,985.12. The next payment is due May 6, 2023.

Communications from the Alderpersons:

The gray house on Poplar Street was questioned on the status of the house and if the City owns it.

The tent company has not responded or repaired the tennis courts. We may need another letter or to file suite.

Under New Business:

ACPA Trunk or Treat will be held on October 30th from 4 to 6 pm at the football field. The council agreed on Trick or Treat hours for Assumption will be from 5 to 8 pm on October 30 and 31. Council Member Nelsen, seconded by Council Member Smith, made a motion to allow trick or treating from 5 to 8 pm on October 30 and October 31. Motion carried with Alderpersons Reed, Smith, Sullivan, Nelsen, Walden and Burgess voting aye and 0 nays.

The Knotty Pine would like to close West Second Street in front of the business on October 15th for Oktoberfest. Council Member Burgess, seconded by Council Member Reed, made a motion to close a portion of West Second Street on October 15th for Oktoberfest. Motion carried with Alderpersons Sullivan, Burgess, Nelsen, Walden, Reed and Smith voting aye and 0 nays.

Resolution 2022-6 was presented for 133 S Chestnut to finalize the TIF application. Council Member Burgess, seconded by Council Member Reed, made a motion to approve Resolution 2022-6 for the TIF application for 133 S Chestnut. Motion carried with Alderpersons Nelsen, Walden, Reed, Smith, Burgess and Sullivan voting aye and 0 nays.

The council reviewed the appraisal for 315 N St John’s Street and would like to take bids for the property. Advertising for sealed bids will be in the newspaper, facebook and the website. The City must get 80% on the appraised value. Council Member Walden, seconded by Council Member Nelsen, made a motion to allow sealed bids for 315 N St John’s Street to be opened at the November 2, 2022 City Council meeting. Motion carried with Alderpersons Smith, Sullivan, Walden, Burgess, Reed and Nelsen voting aye and 0 nays.

The lowest quote for the concession shed roof was $4,000.00 from Jay Hadley. Council Member Smith, seconded by Council Member Nelsen, made a motion to accept the quote for $4,000.00 for a roof for the concession shed by the ball diamond. Motion carried with Alderpersons Walden, Smith, Reed, Nelsen and Sullivan voting aye and Burgess voting nay.

R&B Peters Construction was the lowest quote for $10,500.00 for the concrete sidewalk. Council Member Walden, seconded by Council Member Sullivan, made a motion to approve the quote for $10,500.00 for the concrete sidewalk in front of 1905 Brewing Company and Massage Therapy. Motion carried with Alderpersons Nelsen, Reed, Smith, Sullivan and Walden voting aye and Burgess voting no.

The price for a John Deer 1025R for the Street Department is $19,900.00. Council Member Smith, seconded by Council Member Reed, made a motion to allow the purchase of a John Deer 1025R for $19,900.00. Motion carried with Alderpersons Reed, Smith, Nelsen, Sullivan, Walden and Burgess voting aye and 0 nays.

The cost to disconnect and tie back to the existing storm sewer for Sloan’s from the new Sanitary Sewer is $17,000.00. The work will take approximately 4 days. Council Member Walden, seconded by Council Member Burgess, made a motion to allow Petersburg Plumbing to disconnect and tie back the existing storm sewer for $17,000.00. Motion carried with Alderpersons Smith, Nelsen, Walden, Burgess, Reed and Sullivan voting aye and 0 nays.

The retainage for Sanitary Sewer Phase 1 will need to be released. Council Member Burgess, seconded by Council Member Walden, made a motion to release the retainage for Sanitary Sewer Phase 1. Motion carried with Alderpersons Sullivan, Burgess, Nelsen, Reed, Walden and Smith voting aye and 0 nays.

The disbursement for the Larochelle Project is $100,364.44 for Burdick Plumbing. Council Member Smith, seconded by Council Nelsen, made a motion to approve the disbursement for $100,364.44 for Burdick Plumbing for the Larochelle Project. Motion carried with Alderpersons Nelsen, Walden, Reed, Smith, Burgess and Sullivan voting aye and 0 nays.

The disbursement for lead for Burdick Plumbing is $10,301.76. Council Member Reed, seconded by Council Member Sullivan, made a motion to approve the disbursement for lead for Burdick Plumbing for $10,301.76. Motion carried with Alderpersons Reed, Smith, Nelsen, Sullivan, Walden and Burgess voting aye and 0 nays.

The retention pond at GSI was discussed by the council. The retention pond needs cleaned out. GSI would like to clean out the pond if the City would rent the necessary equipment. Council Member Nelsen, seconded by Council Member Reed, made a motion to approve to rent the equipment for cleanout of the retention pond not to exceed $5,000.00. Motion carried with Alderpersons Reed, Nelsen and Sullivan voting aye and 0 nays. Alderpersons Walden, Smith and Burgess abstained. Mayor Page voting yes.

Mark Bingham updated the council on the Sanitary Sewer Project Phase 1. The council just approved to release the retainage and finalize items are being completed.

Sanitary Sewer Phase 2 is currently meeting with utility companies for relocation of utilities. They will be televising in the near future.

Water Phase 1 is waiting for a permit. The nitrates vessels are waiting for electrical work.

Water Phase 2 is waiting for final guidance from the US EPA.

Larochelle Project is 99.9% completed and waiting for the state to pay back. Public Comments:

The public would like a speed bump put in on West Illinois by the Park.

The public questioned if a ditch could be put in on First and Third Street to help with the run off from the storm water.

Council Member Burgess, seconded by Council Member Walden, made a motion to adjourn at 7:45 pm. Motion carried with Alderpersons Burgess, Nelsen, Reed, Smith, Sullivan and Walden voting aye and 0 nays.
