Illinois lawmakers file lawsuit challenging Senate Bill 328

State Senator Steve McClure and fellow Republican members of the Illinois Senate and House have initiated legal action to challenge the passage of a contentious bill. The lawsuit, filed in Sangamon County on June 18th, questions the constitutionality of how Senate Bill 328 was passed.

Senator McClure emphasized the importance of legislative transparency, stating, “Legislation should be reviewed, scrutinized, and debated in a reasonable and transparent manner before it becomes law.” He further criticized the process by which bills are often passed in last-minute deals without adequate oversight.

The lawsuit targets Senate Bill 328, which underwent significant amendments just hours before its late-night passage on the session's final day. The bill proposes substantial changes to Illinois' judicial system, potentially increasing out-of-state frivolous lawsuits. Business organizations have expressed concerns that this could deter investment and harm the state's economy.

McClure stated, “Ignoring rules for transparency nearly always leads to terrible bills like this one,” and stressed the need for court intervention to restore legislative accountability. He also called on Governor Pritzker to veto the bill and encouraged citizens to petition against it through his website.
