Call to Order

The meeting of the Planning Commission was called to order by Jack Chism, chairman, at 7:00 p.m.

Roll Call

Present: Members: Jack Chism, Judy Cox, Scott Spencer, Lisa Stephens, Don Stover

Also Present: David Willey, City Manager, Joe Craver, Code Enforcement Officer/Building Inspector, Jody Weiss, Recording Secretary, Sue Ann Nelson, City Clerk, Jeff Leidel, WGEL, High School Students

PUBLIC HEARING

 A request from Masa Milling, Inc for a Conditional Use Permit to construct and operate a wastewater pre-treatment facility on Parcel # 05-10-13-504-007, commonly known as 1703 Wolf Drive.

Public Hearing was opened at 7:05 PM. Craver explained that the request is for a pre-treatment plant for wastewater from the factory. This is to have the sewage treated before it is put in the City's sewer system. The building has been sitting vacant for almost 10 years, and this will make the building one step closer to open and begin making Masa flour.

Stephens asked if there will be a methane flame and will it be visible. She is also concerned about the odor of hydrogen sulfide. She would like a guarantee that there will be no odors to neighboring properties. City Manager Willey explained that the flame will be relatively constant, and as long as there is a flame, there will be no odor. He also advised that the EPA will be monitoring the business. Willey also advised that the reactor tank is cleaned out possibly once or twice a year. All paperwork has been completed with the EPA. The tank is approximately 31.5 feet tall and 127 feet in diameter and is above ground on a concrete foundation and will hold 2.6 million gallons. The tank is completely enclosed, and there is a tank rupture plan in place.

Craver advised that all of the approval criteria have been met and that staff recommends the approval of the Conditional Use Permit. Public Hearing closed at 7:35 PM.

Stephens made a motion to approved the Conditional Use Permit with the conditions that the proposed site plan as submitted is adhered to in the development of this property, and that any odor or foul smell is to be confined to the subject's property and undetectable on neighboring properties. Any violation will result in the immediate withdrawal of the conditional use permit. Stover seconded and all voted in favor of the motion to send to the Council.

Stover made a motion to adjourn at 7:45 PM, Spencer seconded and all voted in favor.
