Village of New Baden Board of Trustees met Sept, 6.

Here are the minutes provided by the board:

The Regular Meeting of the New Baden Village Board was held in person and remotely via Zoom Meetings on Tuesday, September 6, 2022. The meeting was held at New Baden Village Hall, 1 E Hanover St, with a physical quorum of the New Baden Village Board present. The meeting was also held via Zoom Meetings. The public could observe and comment, when appropriate, by connecting on line through Zoom Meetings or calling in to participate. The meeting was called to order by Mayor Zurliene at 7:00 pm.

Present and answering to roll call: Mayor Taylor Zurliene; Trustees Nicole Pederson, Chris Locke, Cindi Meredith-Wheelan, Rebecca Schomaker, and Doug Henderson. Absent: Trustee Bob Oster. Staff Members Present: Village Clerk Teri Crane; Village Administrator Erika Heil; Attorney Luke Behme of Bruckert, Behme & Long, P.C.; Chief of Police Chuck Mackin; Public Works Commissioner Tim Deien; Treasurer Casey Weekley; and EMS Director Allen Gilbert (via Zoom Meetings). Staff Members Absent: None.

Zoning Hearing Officer Decision

Board member reviewed the Zoning Hearing Officer Decision from a Public Hearing held via Zoom Meetings on August 9, 2022, for Eric and Pamela Barger for an Area-Bulk Variance at 307 Deborah Court for Relief of Rear Yard and Side Yard setbacks for a detached garage. The Zoning Hearing Officer has recommended to grant the area-bulk variance request to allow the detached garage to encroach into the setback area. An ordinance will be considered later in this meeting.

Treasurer’s Report

Board members reviewed the August and September 2021 Treasurer’s Report prepared by Treasurer Weekley. With the implementation of the new LOCIS software program, there have been delays in getting reports generated.

Consent Agenda

A motion was made by Trustee Pederson and seconded by Trustee Meredith Wheelan to approve the Consent Agenda, which includes the of payment of current invoices, and minutes from the August 1, 2022, regular meeting, the regular meeting on August 15 was cancelled due to lack of business. Consent Agenda also included approving the following: 1) New Baden Chamber of Commerce request to use Village Park grounds for Annual Chili/ Soup Cook-off from 5pm on October 28, through 12 noon on October 30, 2022; 2) Chamber of Commerce request for closure of Circle Drive at Village Park for 2022 Cook-off; 3) Approve Class “E” Liquor License (Civic Organization): New Baden Chamber of Commerce Chili/ Soup Cook-off on Saturday, October 29, 2022; 4) Chamber of Commerce Sign Request for placement of signs at Village Park for 2022 Cook-off; 5) Chamber of Commerce request for Waiving of Fees associated with the Police Protection Policy for 2022 Cook-off; 6) Approve Class “E” Liquor License (Civic Organization): New Baden Zion United Church of Christ for a Wine & Beer Tasting in conjunction with the Festival of Trees on Friday, November 18, 2022, at St. George Community Life Center, 317 E Maple St; and 7) Zion UCC Sign Request for placement of signs at Village Park for Festival of Trees on November 18-20, 2022.

Ayes: Pederson, Locke, Meredith-Wheelan, Schomaker, Henderson.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried.

Ordinance 2022-09-06- A: Prohibiting Parking on Richter School Road

A motion was made by Trustee Schomaker and seconded by Trustee Meredith Wheelan to authorize Ordinance 2022-09-06-A: Prohibiting Parking on Richter School Road. This amends Motor Vehicle Schedule “C” regarding “No Parking”. Public Works Commissioner Deien says that this will help alleviate issues when snow plows are in service and it causes issues with the Fire Protection District when accessing hydrants.

Ayes: Pederson, Locke, Meredith-Wheelan, Schomaker, Henderson.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried.

Ordinance 2022-09-06- B: Area Bulk Variance for 307 Deborah Court

A motion was made by Trustee Schomaker and seconded by Trustee Meredith Wheelan to approve Ordinance 2022-09-06-B: Granting an Area-Bulk Variance for 307 Deborah Court, which allows for the detached garage to encroach approximately 10 feet into the rear setback area and approximately 2 feet into the side yard setback area and to allow said permanent structure within the easements.

Ayes: Pederson, Locke, Meredith-Wheelan, Schomaker, Henderson.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried.

Resolution 2022-09-06- A: Authorizing Execution of a Service Agreement with the Lowest Responsible Bidder for the Supply of Electricity

A motion was made by Trustee Meredith-Wheelan and seconded by Trustee Schomaker to approve Resolution 2022-09-06-A: Authorizing Execution of a Service Agreement with the Lowest Responsible Bidder for the Supply of Electricity for Residential and Small Commercial Retail Customers Who Do Not Opt Out of Such a Program (Electric Aggregation). This resolution provides authority for the Mayor or his designee (Village Clerk Teri Crane) to participate in the Electric Aggregation bid process and make decisions and commitments on behalf of the Village Board. The bid letting is anticipated to be in late September 2022. The current electric aggregation agreement with Homefield Energy will expire in December 2022.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried.

Appoint: Deputy Clerk Erika Brown

A motion was made by Trustee Schomaker and seconded by Trustee Meredith Wheelan to approve the appointment of Village Hall employee Erika Brown as Deputy Clerk.

Ayes: Pederson, Locke, Meredith-Wheelan, Schomaker, Henderson.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried.

PRN EMT Basic: Gabrielle Winegarner

A motion was made by Trustee Pederson and seconded by Trustee Schomaker to approve the hiring of Gabrielle Winegarner as a PRN (as needed) EMT Basic for the New Baden Ambulance Service.

Ayes: Pederson, Locke, Meredith-Wheelan, Schomaker, Henderson.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried.

New Baden Park Boosters: Park BOOster Soccer Tournament

A motion was made by Trustee Meredith-Wheelan and seconded by Trustee Schomaker to approve the use of the Community Park for the Park Boosters 2nd Annual Halloween BOOster Club Kick Off Soccer Tournament on Sunday, October 23, 2022. With a reminder that the Village of New Baden does not supply toilet paper or bathroom cleaning supplies for events hosted by local organizations.

Ayes: Pederson, Locke, Meredith-Wheelan, Schomaker, Henderson.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried.

Republic Services Garbage/ Recycling Contract Extension

Village staff recently acquired the Amendment to the Village’s Municipal Contract with Republic Services for an extended period of five (5) years. Upon review by Village Attorney Behme, Mr. Behme had questions regarding the 4% increase during the last four (4) years of the proposed extension. Due to rounding, the increase was over 4%. Village Administrator Heil will contact Republic Services for additional information. The contract for extension will be presented for consideration at the next Regular Meeting. \

Clearwave Communications

Trustee Pederson inquired on the status of Clearwave Communications proposal to extend fiber optics to residences. Attorney Behme stated that the contracts are being reviewed due to issues with franchise fees and the telecommunications tax. Administrator Heil also stated that Clearwave plans to install a mile a day, which potentially causes issues from the Public Works Department stand point.

Water Meter Installation

Trustee Pederson inquired on the status of the AMI water meter installation. Public Works Commissioner Deien reported that the meters have been delivered and that the installation of the tower antennae is being worked on. Once that is complete, the radios for the meters can begin to be installed.

There being no further business to be brought before the Village Board, a motion was made by Trustee Meredith-Wheelan and seconded by Trustee Schomaker to adjourn the meeting.

Ayes: Pederson, Locke, Meredith-Wheelan, Schomaker, Henderson.

Nays: None.

Absent: Oster.

A majority of the Board voting aye, the motion carried, and the meeting adjourned at 7:47 pm.
